Section II: Agreement
In consideration of being allowed to participate in the Activity and other good and valuable consideration, the receipt of which is hereby acknowledged, I agree with Sundance Square Management, LLC (d/b/a Stretch & Tone Yoga and Sundance Square Yoga) of 450 Houston St, Fort Worth, TX 76102, USA and Jimena Sandoval Carillo (collectively the "Activity Provider") to the following:
1. The Participant will be participating in the yoga classes (the "Activity") provided by the Activity Provider.
2. Being of lawful age and in consideration of being permitted to participate in the Activity, the Participant releases and forever discharges the Activity Provider, the Activity Provider's spouse, heirs, executors, administrators, legal representatives, and assigns from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, and not withstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider.
3. The Participant understands that the Participant would not be permitted to participate in the Activity unless the Participant signed this Waiver.
4. The Participant acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by the Activity Provider, and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns.
5. The Participant acknowledges to the Activity Provider that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. If required, the Participant will obtain a medical examination and clearance.
6. Participant is sufficiently aware of their physical condition to stop participation in the Activity before Participant becomes ill or injured.
7. Participant acknowledges that there is no obligation for any person to provide medical services during the Activity. Participant acknowledges that if medical care is rendered, Participant consents to that care if unable to give consent for any reason at the time care is rendered.
8. Participant agrees not to sue the Activity Provider in connection with Participant’s participation in the Activity, including those claims arising from carelessness, negligence, or gross negligence. Participant agrees to indemnify and hold harmless the Activity Provider from any loss or liability (including legal fees) it may incur in defending any claim made by Participant or anyone on Participant’s behalf.
9. Participant, on behalf of themselves and their heirs and assigns, fully releases, waives, and discharges any and all claims or rights against the Activity Provider.
10. The Participant acknowledges and agrees with the Activity Provider that: (1) the Activity Provider has given the Participant sufficient time to carefully read this Waiver, (2) the Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver, (3) the Participant fully understands the risks and claims that the Participant is waiving to participate in the Activity, (4) the Participant is freely and voluntarily executing this Waiver, and (5) the Participant is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the Activity.
11. This Waiver will be governed by and construed in accordance with the laws of the State of Texas.
Section III: Terms of Service
1. No Late Entry Policy
To support the well-being and focus of all participants, late entry is not permitted once class begins. We recommend arriving 10–15 minutes early to allow time to check in, settle, and prepare. This helps maintain a calm, uninterrupted environment where everyone can fully benefit from their practice. Thank you for respecting this policy and supporting the community experience.
2. Payments and Refunds
All sales are final. We do not offer refunds for class packages, memberships, events, or fees. Memberships may auto-renew according to the terms agreed upon at the time of purchase.
3. Minors
Participants must be at least 14 years old to attend classes. Those under 18 must have a parent or legal guardian sign a consent form in person before participating.
4. Photo and Video Consent
Sundance Square Yoga may occasionally take photos or videos during classes and events for marketing and promotional purposes. By attending, guests grant permission for their image and voice to be used. If you prefer not to be included, please let a team member know before class, and we will do our best to accommodate you.
